Prize Competition Terms and Conditions
BACKGROUND:
These Terms and Conditions set out the terms governing the Affordability Calculator Prize Competition. The promoter of the Prize Competition is LiveMore Capital Limited. Please read these Terms and Conditions carefully and ensure that you understand them before submitting your entry for the Prize Competition.
LiveMore Capital Limited is a limited company registered in England and Wales under company number 11630369. Our registered address is Threeways House, 40-44 Clipstone Street, London, W1W 5DW.
By submitting an entry to the Prize Competition, you are agreeing to accept and be bound by these Terms and Conditions. Please note that We reserve the right to refuse entry or refuse to award a prize to anyone who is in breach of these Terms and Conditions.
1. Definitions and Interpretation
1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
“Closing Date”
means the closing date of each Prize Competition per month, as set out in Clause 3;
“Competition Date”
means the date of each month by which the winner will be chosen, as set out in Clause 5;
“Opening Date”
means the opening date of each monthly Prize Competition, as set out in Clause 3;
“Prize Competition”
means Affordability Calculator Prize Competition; and
“We / Us / Our”
means LiveMore Capital Limited whose details are provided above.
2. Prize Competition Entry Rules
2.1 The Prize Competition is open to mortgage intermediaries. They must be aged 18 and above, subject to the following exceptions.
2.2 The following may not enter the Prize Competition:
Our employees or their families; and/or
Our agents, subcontractors, and any other third parties involved in or directly associated with the running of the Prize Competition.
2.3 Only one entry per person per month is permitted. An intermediary can participate again in one of the Prize Competitions of the other months. If more than one entry per person in one month, only the first entry will be accepted.
3. Opening and Closing Date each month
There will be a separate Prize Competition each month until 30.11.2024, with an opportunity to win £1000 each calendar month.
3.1 The Opening Date of the first Prize Competition is 00:01 on 1 May 2024, and the Closing Date of the first monthly Prize Competition is 23:59 on 31 May 2024.
3.2 Afterwards, the Opening Date and Closing Date will be the 1st of each calendar month until the 30th or 31st of each calendar month, as applicable.
3.3 Entries received after the respective Closing Date will not be valid, accepted, or considered for the Prize Competition of that calendar month. They will be considered for the next month’s Prize Competition.
4. How to Enter the Prize Competition
4.1 Prize Competition entries are free. No purchase is necessary.
4.2 To submit your entry to the Prize Competition:
During the first month’s Prize Competition (May 2024), visit either our intermediary website affordability calculator page, or visit our broker portal and register (if not already registered) ; then use the affordability calculator/Quoting system by entering your clients’ mortgage enquiry to generate a calculation result. You will automatically be provided with a unique code. To enter, you must copy the unique code from the calculator, then click on the hyperlink that is placed just beneath the unique code generator. You will be directed to a competition webpage hosted by LiveMore which has a form to complete in order to enter the competition, stating how you would use the £1000 prize to grow your later life intermediary business.
4.3 Please note that We do not accept any responsibility for any entries which are not successfully completed (e.g. lost or delayed) due to technical faults (including, but not limited to, hardware, software, and network faults) or for entries which We do not receive.
5. The Prize Competition
5.1 A winner will be selected for each month as long as the Prize Competition continues from all entries of that relevant month, by selecting a winning entry which shall be performed by a forum of LiveMore employees which will include Leon Diamond CEO of LiveMore Limited within three weeks of the respective Closing Date.
5.2 The Prize for each monthly Prize Competition will be as follows:
a) £1000 wired to your bank account.
5.3 The winner of each month will be notified by email (using the details provided in their entry) within four weeks after the relevant Competition Date and must respond with a postal address and bank details in order to claim their prize.
5.4 If a winner does not respond to Us within four weeks of being notified, their prize will be forfeited, and We shall be entitled to select another winner for that month using the process set out above.
5.5 The winner will receive their prize by bank transfer within two weeks of their response.
5.6 Prizes are non-exchangeable and non-transferrable.
5.7 Our decision regarding any aspect of the Prize Competition is binding and final. We will not enter into any correspondence about the decision.
5.8 We are required to publish or otherwise make available information which indicates that a valid award has taken place. The surname and county of prize winners (and, where applicable, copies of winning entries) are made available from Us by:
a) Writing to Us at Sarah Wade, LiveMore Mortgages, 2-4 Exmoor Street, London W10 6BD, enclosing a self-addressed envelope; or
b) Sending an email to Us at marketing@livemoremortgages.com;
within six weeks after the relevant Closing Date.
5.9 If you object to any of your information, as set out above in sub-Clause 5.8, being published or otherwise made available, please contact Us by post at LiveMore Capital London W10 6BD, by email at marketing@livemoremortgages.com, or by telephone on 02045257754. Please note that We are still required to provide such information and winning entries to the Advertising Standards Authority on their request.
5.10 A prize winner may be required to participate in reasonable publicity arising out of a promotion. The winner agrees to the use of their name and image in any publicity material, as well as their entry. Any personal data provided will be used solely in connection with this prize competition and will not be used for any other purpose.
5.11 We reserve the right to hold void, cancel, suspend, or amend the promotion if it becomes necessary for us to do so.
6. Limitation of Liability
6.1 Nothing in these Terms and Conditions limits or excludes Our liability (or that of Our agents or distributors, or that of their employees) for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other form of liability that cannot be excluded or limited by law.
6.2 To the extent permitted by law, and subject to sub-Clause 6.1, We (and Our agents and distributors) shall not be responsible or liable to compensate any winner and shall not accept any liability for any loss, damage, death, or personal injury, as a result of accepting a prize.
7 Privacy and Personal Data
We will only use your personal information as set out in Our Privacy Policy, available from livemoremortgages.com/privacy-policy and as explained above in Clauses 5.8 and 5.9.
8. Divers
8.1 We may vary these General Terms or any or terminate a promotion at any time at our absolute discretion if reasonably required to do so. Termination or variation of a promotion is without liability to any entrant or other person. We will not award the prize if a Promotion is terminated.
8.2 All our decisions relating to a Prize Competition are final. No discussions or correspondence with entrants or any other person will be entered into.
8.3 A failure by Us to enforce any of the terms and conditions in the General Terms or Specific Terms in any instance will not give rise to any claim or right of action by any entrant or prize winner, nor shall it be deemed to be a waiver of any of our rights in relation to the same.
8.4 Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded.
8.5 In the event that any provision of these General Terms or any Specific Terms are held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions which shall continue in full force and effect.
9. Law and Jurisdiction
9.1 These Terms and Conditions, the Prize Competition, and the relationship between Us and you (whether contractual or otherwise) shall be governed by, and construed in accordance with, English law.
9.2 Any dispute, controversy, proceedings, or claim between Us and you relating to these Terms and Conditions, the Prize Competition, or to the relationship between Us and you (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, or Scotland, as determined by your residency.
